Terms and rules

1. Introduction

These Terms and Conditions ("Terms") govern your use of the OverTake website and services ("Service"), operated by OverTake ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not register or use the Service.

2. User-Generated Content

You are solely responsible for any content, including but not limited to text, images, and links ("Content") that you submit, post, or upload to the Service. Content must not:

• Be defamatory, abusive, hateful, threatening, or violate any laws.
• Contain adult or objectionable material, personal information without consent, or infringe intellectual property rights.
• Encourage illegal activity or breach any applicable laws.

All Content submitted may be reviewed by our staff and could be sent to third-party verification services, such as spam prevention services. Do not submit any Content you consider private or confidential. We reserve the right to remove or modify any Content at our sole discretion without notice or explanation. You grant us a non-exclusive, irrevocable, perpetual, worldwide license to use, distribute, reproduce, and display the Content in connection with the Service. You retain ownership of the Content but grant us these rights for its use.

3. Intellectual Property and Copyright

If you believe your copyrighted work has been posted on OverTake without your authorization, you may submit a copyright infringement notification. Only the copyright owner or an authorized agent may submit such notifications. To notify us of alleged copyright infringement, you can use the "report" button under each forum post or resource file, or contact us directly via email.

All original game files, encrypted files, and other copyrighted materials are prohibited from being posted or linked. OverTake users must only use legally purchased software for racing on OverTake servers. Users found to be using pirated software will be banned from the community.

Before creating or uploading mods, car skins, helmets, cars, tracks, or other materials, users should obtain official permission from the copyright or trademark holders. Deep-linking to our resources and modding files for any purpose without explicit authorization from OverTake is strictly prohibited.

4. General Conduct

Users must maintain mutual respect across the OverTake community, including forums, article comments, private messages, chat rooms, and game or voice servers. Personal attacks, malicious behavior, and bullying are strictly prohibited. The primary language for communication is English, except in private and profile messages.

Staff members have the authority to edit or remove any content that violates these rules and can issue warnings or ban users if necessary. Heated discussions should not be prolonged in public forums. If conflicts arise, they should be resolved via private messages or email, and normal forum rules apply in these contexts. Aggressive private messages can be reported to the admin team.

5. Content Guidelines

OverTake is a community for all age groups. The following types of content are not permitted:

• False, harassing, or offensive content.
• Offensive pictures, movies, or sexually explicit material.
• Excessive strong language or swearing.
• Discussions centered around race, nationality, religion, politics, cultures, or belief systems.

Spamming, flooding, chain letters, advertising, and recruiting are not allowed. Videos posted solely to advertise a channel or boost views are also prohibited. Content should be primarily focused on discussions. Users should not hotlink, post, attach, or upload other people's content without permission. All links to external downloads must be approved by OverTake.

6. Avatars, Signatures, and Profile Pictures

Avatars, signatures, and profile pictures must adhere to the same rules as other content streams. They should not contain sexually explicit content, offensive material, or advertisements.

7. User Accounts

Users are prohibited from holding more than one account without express permission from an administrator. Accounts created without permission will be banned without warning. Users are responsible for keeping their login credentials secure. Sharing accounts or creating additional accounts to circumvent bans or restrictions will result in immediate banning of all associated accounts.

Usernames should not be advertisements. If a username causes issues or conflicts within our systems, staff may request that the user choose a new one, or a new username may be assigned.

8. Privacy and Data Protection

By using the Service, you agree that OverTake may collect, store, and use your personal information as described in our Privacy Policy. Users should ensure that their submitted content does not contain private or confidential information that they do not wish to be disclosed.

9. Liability and Indemnity

OverTake does not guarantee the accuracy, reliability, or completeness of any content provided by users on the Service. You agree to indemnify and hold harmless OverTake, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

10. Modifications to the Terms

These Terms may be changed at any time without prior notice. It is your responsibility to review these Terms regularly. Continued use of the Service following any changes to the Terms constitutes your acceptance of those changes.

11. Termination

We reserve the right to terminate or suspend your access to the Service, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OverTake operates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
